Access to the site www.kogedesign.com and its use are subject to the following general conditions. The customer is required to carefully read the general conditions before placing an order.

Purpose
KØGE Design offers products for sale online. The customer visits the website and fills the shopping cart with the products they wish to purchase. The customer will then accept the general conditions and make payment for their order using one of the payment solutions available on the site. Then the customer will confirm their order. KØGE Design will then send them an order confirmation email. The sales contract between KØGE Design and the customer is concluded upon receipt of the confirmation email.
KØGE Design reserves the right to request additional information from the customer and to refuse certain orders, in particular if the customer is a minor, if there is an ongoing dispute, if stock levels do not allow to honor the order or if there is a manifest error in the description or price of the products. Only legally competent persons can place an order.
Application and acceptance of general sales conditions
An order will in all cases involve the express and irrevocable acceptance of these general conditions by the customer. The customer will receive a link to the general conditions in a format that can be saved or printed in the order confirmation email. Some provisions of the general conditions only apply to consumers.
Delivery and payment fees and terms
Any potential delivery charges are indicated in the order summary on the website before the customer confirms their order. These charges are also included in the confirmation email. KØGE Design undertakes to respect the delivery times indicated on each product page. For security reasons, the customer may be asked to provide proof of identity upon delivery. In case of first absence during the carrier's visit, a new presentation will take place. In case of second absence, the package will be made available at a collection point near the destination. No compensation can be claimed by the customer in case of delayed delivery.
Upon delivery, the customer checks and agrees to the information and data listed on the invoice. They also confirm that the delivered products, as far as this is visible, comply with the description made by KØGE Design and are suitable for the usual use of such products. Any defect must be communicated to the carrier or collection point. If some products are not compliant at the time of delivery, the customer immediately notifies KØGE Design customer service.
Price and information on the site
All prices listed on the website include VAT and other taxes. These prices may be changed at any time and do not include, where applicable, delivery charges. The prices paid by the customer are those mentioned on the site at the time of the confirmation email, except in the case of a manifest error.
The photos and other illustrations used to present the products have no contractual value and may show products or elements not included in the proposed price.
Right of withdrawal (only for consumers) and return costs
The customer has the right to withdraw only for products that are not on order.
Product compliance
KØGE Design guarantees that the products comply with the contract, the specifications described on the site and the reasonable requirements regarding their quality and utility. In the event that an apparent defect or non-compliance is detected, the customer must immediately and imperatively report this to KØGE Design, under penalty of forfeiture of their rights in this respect, without prejudice to the rights granted by articles 1649bis and following of the civil code if the customer is a consumer and by articles 1641 and following if the customer is not a consumer. In this second case, it is presumed that KØGE Design was not aware of the hidden defect.
Proof
The emails and the automatic registration systems of the website serve as proof, notably for the date of the order and its content.

Responsibility
KØGE Design cannot be held responsible for misuse of products or for any modifications to the products made by the manufacturers. The liability of KØGE Design is in any case limited to the amount of the order and cannot be engaged for simple errors which could have remained despite all the attention paid to the presentation of the products. In no case can KØGE Design be held liable for indirect or consequential damage, nor for damage that was not foreseeable at the time of the order. Neither the photos, illustrations or product sheets engage KØGE Design. This information is provided for informational purposes. The customer agrees to read carefully the notice provided by the manufacturer on or in the product packaging.
Personal data
KØGE Design respects the Belgian law of 8 December 1992 as revised on the processing of personal data. The customer has the right to access, modify, rectify and delete data concerning them by addressing KØGE Design.
KØGE Design undertakes not to communicate the details of its customers to a third party without prior agreement.
Intellectual rights
The name and logo of KØGE Design as well as those of the companies mentioned on the website are protected names and brands. The intellectual rights related to the website are the exclusive property of KØGE Design, HNY Design or its contractors. The information appearing on the site cannot be made public, reproduced, or modified without the prior written permission of KØGE Design, except for strictly personal use.
Miscellaneous
The fact that a provision of these general conditions is declared invalid, illegal or null does not affect the validity, legality or applicability of the other provisions. The fact that KØGE Design fails to require strict application of one or more provisions of the general conditions does not constitute a tacit waiver of its rights and does not prevent it from subsequently requiring strict compliance with these provisions.
KØGE Design is not responsible for delayed execution or non-performance of the Service due to force majeure. Cases of force majeure are considered to be those usually recognized by Belgian case law and courts. In case of force majeure, KØGE Design is authorized to deliver the products during the 60 days following the contractually agreed date. After this period, the customer may cancel their order.
Any dispute will be governed by Belgian law. Only the courts of Brussels have jurisdiction.
