Access to and use of the website www.kogedesign.com (hereinafter "the Site"), including the purchase of products offered by KØGE Design, are subject to these General Terms and Conditions of Sale (hereinafter "T&Cs"). By placing an order on the Site, the customer acknowledges having read, understood, and accepted, without reservation or restriction, the entirety of these T&Cs in force at the time of the order. The customer is therefore required to carefully read the T&Cs before placing an order.
The brand KØGE Design and its website www.kogedesign.com are operated by the company HNY Design.

KØGE Design offers products for sale online via the Site. The customer selects the desired products and adds them to their shopping cart. To finalize the order, the customer must provide the necessary information, accept these T&Cs, and make the payment using one of the solutions offered. After payment validation and acceptance of the order by KØGE Design, the customer receives a confirmation email summarizing their order. The sales contract between KØGE Design and the customer is considered concluded upon the customer's receipt of this confirmation email, subject to the actual availability of the ordered products.
KØGE Design reserves the right to request additional information from the customer and to refuse or cancel an order for legitimate reasons, including (but not limited to) if the customer is a minor, if there is a previous or ongoing dispute with the customer, in case of total or partial non-payment of a previous order, in case of unavailability of products, if the information provided by the customer is incomplete or inaccurate, or in case of a manifest error in the description or price of the products (e.g., a ridiculously low price). Only persons legally capable of entering into contracts may place orders on the Site.
Placing an order on the Site implies the customer's full, complete, and irrevocable acceptance of these T&Cs, to the exclusion of all other conditions. The applicable T&Cs are those in force on the Site at the time the order is placed. The customer will receive a link to the T&Cs in force at the time of their order in the order confirmation email, in a format that can be saved or printed. Certain provisions of the T&Cs may only apply to customers qualifying as "consumers" under the law.
Payment: Payment of the total price is due at the time of the order. KØGE Design uses Stripe's services to process payments securely and thus supports a multitude of payment methods (such as credit/debit cards, etc.). The specific payment methods available for a given order are indicated during the checkout process on the Site. KØGE Design reserves the right to add, modify, or remove payment methods at any time.
Delivery: Any applicable delivery costs are calculated and indicated in the order summary on the Site before the customer confirms the order. These costs are also included in the confirmation email. KØGE Design undertakes to respect the delivery times indicated on each product page at the time of the order, except in cases of force majeure or exceptional circumstances. For security reasons, proof of identity may be requested upon delivery.
Receipt and Verification: It is the customer's responsibility to check the apparent condition of the parcel and products at the time of delivery, in the presence of the carrier. In case of visible damage to the packaging (damaged parcel, opened, signs of impact...), the customer must imperatively:
If the customer is absent during the carrier's visit, a delivery notice will be left, indicating how to arrange a new delivery attempt or collect the parcel from a collection point. No compensation can be claimed by the customer for delivery delays not attributable to gross negligence by KØGE Design.
All prices mentioned on the Site are indicated in Euros (€) and/or other currencies selectable by the customer, and include local VAT and other applicable taxes as of the order date. Any change in the applicable VAT rate may be reflected in the product prices. Prices may be modified by KØGE Design at any time, but products will be invoiced based on the rates in effect at the time the order is validated, except in cases of manifest error. The indicated prices do not include delivery costs, which are charged in addition and indicated before the final validation of the order. The final transaction currency will be clearly indicated during the payment process.
The photos, descriptions, and other illustrations used to present the products on the Site are as accurate as possible but have no binding contractual value. They may show products or elements not included in the offered price. KØGE Design strives to promptly correct any errors or omissions that may occur in the presentation of products.
In accordance with the law, the consumer customer has a right of withdrawal of 14 calendar days starting from the day after receiving the product, without having to provide reasons or pay penalties, except for the return shipping costs which remain their responsibility. However, this right does not apply to products made to the consumer's specifications or clearly personalized (custom-made products).

The Return Policy is an integral part of these T&Cs.
KØGE Design is obliged to deliver products that conform to the sales contract and is liable for any lack of conformity existing at the time of delivery, in accordance with articles 1649bis and following of the Belgian Civil Code (legal guarantee of conformity for consumers). This legal guarantee lasts for two (2) years from the delivery of the goods for any defect that existed at the time of delivery and appears within this period.
The consumer customer must report any lack of conformity to KØGE Design by email (hello@kogedesign.com) as soon as possible and at the latest within two months from the day they discovered the defect. To invoke the legal guarantee, the customer must provide proof of purchase.
The guarantee does not cover defects resulting from misuse, accident, modification of the product by the customer, normal wear and tear, failure to follow usage or maintenance instructions, or use not conforming to the product's intended purpose.
In case of a proven lack of conformity reported within the deadlines, KØGE Design will offer, depending on the case and applicable legislation, repair, replacement of the product, or, if this proves impossible or disproportionate, a price reduction or termination of the contract with a refund. Any warranty claim must be addressed by email to hello@kogedesign.com for assessment and finding a solution.
For non-consumer customers (professionals), the applicable guarantee is that for hidden defects provided for in articles 1641 and following of the Civil Code, under the conditions provided by law. It is presumed that KØGE Design was unaware of the hidden defect.
Email communications between the parties, as well as the automatic recording systems used on the Site (logs), are considered to have probative force, particularly regarding the nature, content, and date of the order and exchanges.

KØGE Design cannot be held liable for improper use of the products by the customer, nor for any modifications made to the products by manufacturers without notice. KØGE Design's liability will, in any event, be limited to the amount of the order for direct damages suffered by the customer, and cannot be engaged for simple errors or omissions that may have remained despite all the care taken in presenting the products. KØGE Design shall not be liable for indirect or consequential damages, loss of business, or loss of profit. The above liability limitations do not apply in cases of fraud, gross negligence by KØGE Design, or in case of personal injury or death resulting from a product defect, nor in case of violation of mandatory legal provisions, particularly regarding the legal guarantee of conformity for consumers.
The customer undertakes to carefully read the notice and information provided by the manufacturer on or in the product packaging before use.
KØGE Design (HNY Design) collects and processes customers' personal data in the context of order management, customer relations, and the operation of the Site, in accordance with its Privacy Policy available here: https://kogedesign.com/policies/privacy-policy.
This policy details the types of data collected, the purposes and legal bases of processing, the retention period, security measures, potential data transfers, as well as the rights customers have regarding their personal data (access, rectification, deletion, limitation, portability, opposition) and how to exercise them, in accordance with the General Data Protection Regulation (GDPR) and applicable laws. The Privacy Policy is an integral part of these T&Cs.
The KØGE Design name and logo, as well as all content present on the Site (texts, images, graphics, logos, icons, sounds, software...) are the exclusive property of HNY Design or its partners and are protected by Belgian and international intellectual property laws. Any reproduction, representation, modification, publication, adaptation of all or part of the Site's elements, regardless of the means or process used, is prohibited without the prior written permission of HNY Design. Any unauthorized use of the Site or any of the elements it contains will be considered as constituting an infringement and prosecuted.
If one or more provisions of these T&Cs are held to be invalid or declared such pursuant to a law, regulation, or following a final decision of a competent court, the other provisions shall remain in full force and effect. KØGE Design's failure to enforce at any time any of the provisions of these T&Cs shall not be construed as a waiver of its right to enforce such provision at a later time.
KØGE Design shall not be liable for the total or partial non-performance of its obligations under this contract if such non-performance is caused by an event constituting force majeure, as recognized by Belgian case law. In the event of a force majeure event, KØGE Design will inform the customer and suspend the performance of its obligations for the duration of the event. If the force majeure event persists beyond a reasonable period (e.g., 60 days), either party shall be entitled to terminate the contract without compensation.
These General Terms and Conditions of Sale and the transactions arising therefrom are governed by and subject to Belgian law.
In the event of a dispute, the customer is invited to contact KØGE Design (hello@kogedesign.com) to seek an amicable solution. Failing an amicable agreement, for disputes between KØGE Design and a professional customer, exclusive jurisdiction is granted to the Enterprise Court of Walloon Brabant (Tribunal de l’entreprise du Brabant wallon).
For consumer customers, in accordance with the Code of Economic Law, they may also submit the dispute either to the courts competent under common law, or to the European Online Dispute Resolution (ODR) platform accessible at the following address: http://ec.europa.eu/consumers/odr/. This platform facilitates the out-of-court resolution of consumer disputes.
